Is it illegal to use social media apps while driving?

With the rise of social media platforms, distracted driving has become a major concern across the country. Mobile phone use has increased, and so has the risk of accidents caused by drivers who divert their attention from the road to their screens. Whether texting, scrolling through social media apps or checking notifications, this behavior endangers the driver, passengers and everyone else on the road.  

Understanding the legal implications of using mobile devices while driving is crucial for Tennessee drivers. These laws are not just about keeping individuals safe; they also carry consequences for violations, including fines, points on your driving record and potential liability in accidents.  

Tennessee’s distracted driving laws 

Tennessee’s hands-free law, enacted in 2019, makes it illegal to hold or physically support a phone while operating a motor vehicle. Drivers are prohibited from texting, emailing, watching videos or interacting with any handheld device. While voice-activated or hands-free systems are permitted, drivers must focus on the road at all times. 

The hands-free law applies to highways, local streets and parking areas. For example, a driver stopped at a red light or waiting in traffic is still subject to these restrictions.  

Even a glance at a phone could constitute a violation if it distracts the driver from their primary responsibility of safely operating the vehicle. Law enforcement agencies are vigilant about identifying and penalizing offenders, using marked and unmarked vehicles to observe driver behavior. 

Penalties for violating Tennessee’s distracted driving laws can include fines and points on the driver’s license. For first-time offenders, the fine is $50, while repeat offenses carry higher penalties, up to $200 for violations in active school or work zones. Beyond monetary fines, violations add demerit points to a driver’s record, which could lead to higher insurance premiums or even license suspension for accumulated points. 

Distracted driving involving social media use has risks and legal consequences for Tennessee drivers. Drivers who find themselves in legal trouble regarding distracted driving or need guidance after an accident can benefit from a legal consultation to understand their options better.
