Can drivers hold bicyclists responsible for a crash?

Drivers typically expect bicyclists to be careful – especially when they’re wearing serious biking gear which indicates that they ride many miles on a regular basis. Unfortunately, bicyclists of all ages and experience levels may neglect to follow the state’s bicycle laws and take chances with their own safety and those of others on the road.

Sometimes, no matter how careful a driver is to allow at least the required three feet between their car and cyclists who may be traveling in either a bike lane or traffic lane, one wrong move by a cyclist can result in tragedy. While cyclists typically bear the brunt of the injuries in a bike vs. car collision, those in cars and larger vehicles can be seriously injured if they swerve to avoid a bike and strike another vehicle (particularly one going in the opposite direction) or stationary object like a tree, light pole or traffic light.

Why e-bikes can lead to more serious crashes

The risk of bicycle vs. motor vehicle crashes has gotten worse with the growing popularity of electric bikes (e-bikes). Their heavier weight and added speed let riders venture onto steep roads that they may not ordinarily be able to climb on a traditional bike. E-bikes also can go at higher speed, which makes any collision more dangerous for everyone who is involved.

A cyclist may have insurance coverage for these crashes

Negligent, reckless and/or distracted bicyclists can be held responsible for a crash that they’ve caused. Their auto or other insurance policy may cover crashes they’re responsible for. If that coverage isn’t enough to pay for expenses and damages, it may be necessary to hold them (or their parents, if they’re a minor) financially responsible via a personal injury lawsuit.

If you or a loved one has been injured due to the reckless actions of a cyclist, it’s wise to gather as much evidence as possible. That can include witness statements, surveillance video from nearby security cameras (including doorbell cameras) and even the cyclist’s own video footage if they have a bike and/or helmet camera.
